Welcome to Simcha. These Terms of Service ("Terms") govern your use of simchawedding.art (the "Site") and any artwork or services you order from the studio. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

About the studio

Simcha is an independent art studio creating handcrafted Jewish art, ketubot, and commissioned pieces. The Site is a portfolio and catalogue: it does not include an automated checkout. Orders and commissions are arranged personally, primarily through WhatsApp and direct conversation.

Using the Site

You agree to use the Site lawfully and not to misuse it, interfere with its operation, attempt to gain unauthorised access, or use it in any way that could harm the studio or others.

Intellectual property

All artwork, images, designs, text, and other content on the Site are the property of Simcha (or used with permission) and are protected by copyright and other laws. You may not copy, reproduce, distribute, sell, or create derivative works from any content without our prior written permission. Purchasing a piece of artwork does not transfer its copyright, which remains with the studio.

Orders, quotes, and commissions

Prices shown on the Site are indicative and may change. A final price is confirmed when we discuss your order or commission directly. Custom and commissioned work typically involves sharing your requirements, agreeing on a concept, and approving details before the piece is created.

Payment terms, deposits, and timelines for commissions are agreed directly between you and the studio. We are not an automated store and do not collect or store payment details through this website.

Handmade items

Each piece is made by hand. Natural variation in colour, gold leaf, paper, texture, and finish is part of the character of handcrafted work, and slight differences from images on the Site are to be expected rather than considered defects.

Custom work, cancellations, and returns

Because custom and commissioned pieces are made specifically for you and often personalised, they generally cannot be cancelled once work has begun, and are not eligible for return or exchange except where required by law. If something is not right with your order, please contact us as soon as possible and we will do our best to make it right.

Shipping and delivery

Production and delivery timelines vary depending on the piece and are confirmed with you directly. Once an item is handed to a shipping carrier, delivery times and any customs duties or import taxes are outside the studio's control and are the responsibility of the recipient.

Third-party links

The Site links to third-party platforms such as Instagram, Etsy, Redbubble, Spotify, and WhatsApp. We are not responsible for the content, products, or practices of those sites, and your use of them is governed by their own terms.

Disclaimer

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the Site will always be available, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Simcha shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site. Nothing in these Terms limits any rights you may have that cannot be excluded under applicable law.

Governing law

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. Any disputes shall be subject to the competent courts located in Israel, unless applicable consumer law provides otherwise.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site means you accept the updated Terms.
